UPDATE: Brooklyn NAACP Lawsuit on Line Warming Ban

Today, Judge Failla issued her order denying defendants’ motion to dismiss. Judge Failla’s order means we have sufficiently alleged enough information to withstand defendants’ motion to dismiss and move forward to the next stages of litigation.


As you may remember, the Brooklyn Branch challenged the state’s linewarming ban – which prohibits nonpartisan groups from providing food and drink to individuals waiting in line to vote. Our Amended Complaint alleged that the ban violates the First and 14th Amendments because it is overbroad, vague, and places unconstitutional restrictions on free speech and the political process.


Given Judge Failla’s green light to move forward, our attorneys at Elias Law Group are preparing for the next steps.
